By its terms, the VCCR applies whenever a foreign national is arrested or otherwise detained in the United States, and thus in theory all the discussion that follows is as applicable to the defense of non-capital charges as it is to capital charges.

(c) Consular officers shall have the right to visit a national of the sending State who is in prison, custody or detention, to converse and correspond with him and to arrange for his legal representation.
Nevertheless, consular officers shall refrain from taking action on behalf of a national who is in prison, custody or detention if he expressly opposes such action.
The Convention is accompanied by an Optional Protocol Concerning the Compulsory Settlement of Disputes, to which these three states are also parties.

As many as 70 of the 74 foreign nationals awaiting execution on America's "death rows" were never told of their right to contact their consulate, an omission that is a violation of the Vienna Convention on Consular Relations.
The failure of police departments to notify foreign nationals of their right to consular assistance is increasingly reaching the courts, although the claim is consistently rejected as a basis for clemency.
After each execution of a foreign national who was not told of the right to consular assistance, the State Department has issued a formal apology that the police did not follow the Vienna Convention, but has never tried to stop an execution.
