In 2004, Vitali was the reigning heavyweight champion, having inherited his WBC title from Lennox Lewis and successfully defending it in consecutive demolitions of Corrie Sanders and Danny Williams.
While Wladimir is considered the top heavyweight, it was Vitali who gave Lewis all he could handle in their '03 meeting (a fight seen by 4.6 million HBO viewers, the highest rated heavyweight bout since 1997) and was on course to become Lewis' heir.
Klitschko claims the WBC designated him as its "champion emeritus" and assured him he would become the mandatory challenger if and when he decided to return.

Vitali Vladimirovich Klitschko (Ukrainian: Віталій Володимирович Кличко – Vitalij Volodymyrovyč Klyčko; born July 19, 1971), known as "Dr. Iron Fist", was a professional boxer from 1996 through 2005; he was the WBC heavyweight boxing champion of the world in 2004 and 2005.
Klitschko was rocked early by the powerful Sanders, but by using movement and strong punching he broke down Sanders and forced the referee to stop the bout.
Klitschko easily threw many punches during the fight, knocking Williams down in the 1st, 3rd, 7th, and 8th rounds before the fight was mercifully stopped.

LOS ANGELES — Two weeks ago, Vitali Klitschko learned that he would finally get an opportunity to fight for the heavyweight championship of the world, something he's dreamt about since he was an amateur boxer.
Klitschko, 32-1 (31), stayed as cool as he does when he fights upon learning that Kirk Johnson, the original opponent for Lewis, had to pull out of the June 21 title bout to be held at the STAPLES Center because of a sparring injury.
Klitschko was originally supposed to share Saturday's card with Lewis in a co-featured bout against undefeated Cedric Boswell, which would have set up a showdown with the heavyweight champ sometime in December of this year.

I believe Vitali Klitschko needs to sue by law the "referee" who voluntarily stopped his fight with Lewis, in which Vitali lead on points, despite of his face cuts, and to obtain via court the decision to finish the remaining 6 rounds of this match with a compensation for the referee's voluntary actions.
As Vitali insisted on the continuation, this "referee" didn't have the right to refuse -- with Vitali's agreement to continue the match, all responsibility for possible health damage would be his.
BTW, after Lewis cut Klitschko's eyebrow, he hit Klitschko with his head to increase the cut -- but the referee preferred not to remark this.
