When the regulatory fees for construction permits were established in 1994, the fee was set at an amount that was commensurate to the limited nature of station operations under the terms of a construction permit.
In its notice, the FCC noted that the combination of increasing expected revenue and decreasing payment units for the construction permits has resulted in a regulatory unit fee that is higher than that of some licensed stations.
To rectify this situation, the FCC has set the AM, FM, VHF and UHF construction permit fee to be no higher than the regulatory fee associated with the lowest licensed station for that fee category.
