WXTV asserts that Cablevision responded to the request by refusing to carry the station on channel 41 and hinted of a non-binding proposal that in the future, as systems are rebuilt, its signal may be moved to an advantageous channel position.
WXTV states that television stations can only change their elections during the election periods, which occur three years apart; thus, Cablevision has known for two and one-half years now what channel every station in the market wishes to be carried on and could move to enforce.

WXTV became the number one station in prime time in New York City--the largest TV market--in the July sweep period, beating all English and Spanish-language stations in the adults 18-49 and 25-54 demographics.
WXTV pulled in 203,000 viewers for 18-49; and 230,000 for 25-54, according to Nielsen Media Research.

In a historic first, WXTV, Univision Communications’ owned-and-operated TV station in New York, has won the market’s prime-time ratings race for the month of August, according to Nielsen Media Research’s local people meter ratings in the market.
For the the survey period from July 28 through Aug. 24, WXTV placed first among the two key demographic groups, adults 18-49 and 25-54.
Among 25-54 year-olds, WXTV scored a 2.7/7, followed by WCBS with a 2.3/6, WNBC with a 2.2/6, and WABC with a 2.0/6.
