Wabash Trace’s arguments are based on the premise that the three original deeds conveyed a fee simple title to the railroad which the railroad and its successors retained until the railroad formally disclaimed any interest in the right-of-way and passed its title to Wabash Trace through the 1995 quitclaim deed.
Wabash Trace argues that when Norfolk stopped using the tract for railroad purposes in 1983 or 1984, use for railroad purposes ended and, if the land was held by Norfolk only as an easement and not in fee, that is when any reversion occurred, and when any adverse possession claim would have begun to run.
In that case, Wabash Trace appealed from a decision of the Circuit Court of Nodaway County quieting title to segments of the same abandoned railroad in favor of adjoining landowners in Nodaway County, Missouri.

In 1991, the Missouri Friends of the Wabash Trace Nature Trail, Inc. (Wabash) offered Norfolk $13,000 for a quit claim deed conveying 25.6 miles of the right of way to the organization for use as a hiking, biking, cross-country skiing, and nature trail.
During the transaction between Wabash and Norfolk, Carroll Lee Boyles, owner of property adjacent to the right of way, began mowing a portion of the right of way and erected fences across it.
Wabash's argument that the right of way was not abandoned, but put to a new use as a trail did not persuade the court.

Unlike many rail-trails that are owned and maintained by a public agency, the Wabash Trace Nature Trail depends entirely on the efforts of private citizens who build, maintain and manage the trail.
While the Trace is owned by a public/private partnership between the Page County Conservation Board and the Iowa Natural Heritage Foundation (a nonprofit organization that protects Iowa's land, water and wildlife), trail management duties fall to Southwest Iowa Nature Trails, Inc. (SWINT).
The preservation of the old Wabash Railroad line is due to the efforts of local trails activists, making the Wabash Trace Nature Trail a wonderful recreational resource and a piece of living history.

The Anthony Wayne Area Council is the oldest council in the state that has kept the same name and headquarter city, dating back to 1925 in its current form while the Wabash Valley Council appears to have the earliest roots in the Hoosier state, going back to 1912.
BUFFALO TRACE COUNCIL http://members.sigecom.net/bsa156/, is based in Evansville IN which has undergone quite a few name changes beginning with its founding in 1914.
It is interesting to note that both of these names used by the Scouters of Princeton were later picked up by other councils in other parts of the state for their own council names.
