First, I have to say it is against Geneva Conventions to shoot injured combatants.
So, technically it is a warcrime, and the incident is being investigated.
This Soldier is innocent of war crimes because there was no way he could know whehter or not this insurgent would try to shoot them, or let a grenade loose, since the insurgents had been doing this all through Fallujah.

BRUSSELS, June 19: Warcrime lawsuits have been filed in Belgium against eight top officials, including US President George W. Bush and British Prime Minister Tony Blair, the Belgian authorities said on Thursday.
But the Belgian government has refused to handle the cases arising from the conflict in Iraq, referring them to the US and British governments, the justice ministry said.

The Wehrmacht War Crimes Bureau (the organization tasked with recording any and all allegations and acts considered crimes against German soldiers), determined that this horrific tragedy was in fact not a warcrime because the Stuttgart was partially camouflaged while at anchor.
To be considered a warcrime, according to the rules of the Hague Convention, when the Stuttgart was attacked it would have had to have been free of any camouflage, even while at anchor - although the Stuttgart was unarmed and did have Red Cross markings displayed on its decks at the time of the attack.

Everyone knows about the Nazi camps,and those were horrible,but after reading about some of the things the Japanese did to captured Allied soldiers,I can only give my vote to the Japanese.
When it comes to warcrimes (as opposed to 'crimes against humanity' such as the Final Solution etc) the Japanese beat the German hands down.
What happened at Nanking and unit 731 is proof and is just the tip.

 The British Theatre Guide: News for 16th March, 2003
Oliver Cotton, Susan Engel and Alan David are to co-star with Ralph Fiennes in the RSC production of Ibsen's Brand, which runs at the Swan, Stratford, from 17th April to 24th May 2003, and then transfers to the Theatre Royal Haymarket 4th June to 30th August (previews from 29th May).
Theatre Underground, a new theatrical venue in the crypt of St Andrew's Church in Holborn, is to play host to David William's play Warcrime, in which the pilot who launched a c;uster-bom which hits the wrong target comes face to face with ne of the civilian victims, a waitress.
The play runs from 24th March to 19th April.
