Moore contends that Sergeant Wisneski’s warrantless confiscation of his handgun in January 2002 “was not justified by probable cause” and violated his right to be free from unreasonable seizures under the Fourth Amendment to the United States Constitution.
Moore characterizes the subsequent test-firing of the handgun as an unconstitutional search and contends that the trial court committed reversible error in admitting ballistics evidence obtained as a result of the seizure and test-firing of the handgun.
Moore points to Ward’s initial denial of involvement in the crimes, his incentive to implicate Moore and receive favorable treatment from the State, and minor inconsistencies between his testimony and other evidence in the record, but these do not render his testimony inherently improbable such that no reasonable person could believe it.

Ward Moore tells the story from the point of view of Hodgins Backmaker, a lovable, dreamy bumpkin born on a poor farm in the Hudson River valley of New York.
In “Hodge” Backmaker, Moore is compellingly creates that most difficult of characters, the “passive hero.” His every effort is ineffectual, his every wish and dream frustrated by events or by his own bumbling.
Ward Moore thus works a supremely ironic twist on the “great man” theory of history: an ordinary, even mediocre person can affect the course of events simply by being in the right place at the wrong time.

Moore was initially as well known for his works outside the sf field—like the picaresque Breathe the Air Again (1942)—as for those within.
Moore also wrote two of the most notable stories describing nuclear holocaust and its consequences, "Lot" (1953) and "Lot's Daughter" (1954), featuring a great motorized exodus from a doomed Los Angeles, seen through biblical parallelism as the city of Sodom.

Ward Moore: Bring the Jubilee - an infinity plus review
Ward Moore (who died in 1978) is one of those authors whose reputation rests on just one story, namely this one.
It didn't make a great impression: returning to it twenty-one years later, all I remembered was Moore's idiosyncratic punctuation (he frequently leaves out apostrophes and hyphens) and the ending, which I won't do more than hint at here.
Knowing that ending, you notice Moore's use of foreshadowing and a consistent theme of interference, of passive spectatorship versus active participation.
