Waste (law) - Wikipedia, the free encyclopedia
Waste is a term used in the law of real property to describe a cause of action that can be brought in court to address a change in condition of real property brought about by a current tenant that damages or destroys the value of that property.
A lawsuit for waste can be brought against a life tenant or lessee of a leasehold estate, either by a current landlord or by the owner of a vested future interest.
There, a person found to have committed voluntary waste without the written permission of the holder of the future interest is forced to pay treble damages to the holder of the future interest, and his or her present interest (whether a life estate or a lease) is automatically terminated.

But it is also the only state to include waste coal as one of those alternative sources, despite the fact the legislation grew out of a desire to force the proliferation of cleaner energies.
Many lawmakers insisted on waste coal, and the administration of Gov. Ed Rendell agreed, seeing it as a way to create jobs and clean up the estimated 240 million tons of waste coal that sit on the state's landscape, leaking acidic runoff into streams and other waterways.
Without waste coal in the law, the state's waste coal plants will have a hard time competing with other power plants that are larger and can process fuel at a lower cost, said Billie Ramsey, who heads a Harrisburg-based waste coal industry group.

The objective may be to impose an economic incentive for industrial waste producers to dispose of solid waste on-site, to generate revenue to construct and operate publicly owned facilities, to create a disincentive for generally disfavored methods of disposal, or to encourage waste minimization.
The law imposes what appears to be a duty on the part of the generator to pick his or her contractors wisely, and the law also appears to impose on the generator of the waste the responsibility to police the activities of transporters, handlers, and disposers of the enterprise’s waste.

The draft Law on Processing and Consumer Waste of the Kyrgyz Republic ensures government maintenance of standards, regulation and prevention of any negative impact on the environment and human health during waste handling, and maximization of the use of waste as supplementary raw materials.
The law imposes obligations on generators of waste to adopt waste minimization techniques, but the law should be more specific and use the issuance of permits as a check on whether generators are meeting their obligations.
The draft law is commendable in that the law imposes an obligation upon local and state governments to keep the public informed about relevant waste handling activities 2 and obligations upon the environmental protection agency to ensure that the public has access to information about waste handling.

CNN.com - Fight over Nevada nuclear waste site shifts to the courts - Jan. 15, 2004
Opponents of a planned nuclear waste dump in Nevada argued in court Wednesday the government has failed to ensure that the public will be protected when radiation from the entombed waste reaches its peak hundreds of thousands of years from now.
Attorneys for Nevada and an environmental group asked a three-judge panel to reject the Bush administration's plan for storing highly radioactive waste at Yucca Mountain in the Nevada desert unless it can be shown protective radiation standards can be met at least 300,000 years into the future, when some of the isotopes are most dangerous.
The question of time is important because the reliance on engineered barriers to isolate waste at the site would not be possible 300,000 years into the future.
