The law recognises certain principles on which discretion must be exercised and these are known as the Wednesbury principles.[1] It is possible for the courts to strike out an action taken by a trust that exceeds the limits of its discretion.
The government's policy of introducing Foundation trusts is not to wreck the whole of the NHS or to spark more unreasonable pay spirals but to improve the standards of care delivered to NHS patients and offer greater freedoms from central control for hospital management teams that can be trusted to act in a responsible manner.
Failure to follow Wednesbury principles when exercising discretionary powers may lead to detrimental, excessive, divisive pay awards and it is the responsibility of trust boards applying for Foundation trust status, such as that of UCLH, to ensure that these principles are applied so that pay spirals and undermining of the NHS is avoided.
