The Township defendants waived their right to a hearing on the preliminary injunction and the Court of Common Pleas on October 17 enjoined the Township from enforcing or attempting to enforce the two resolutions or any other resolutions prohibiting the videotaping of public meetings.
Whiteland Woods then sought additional relief, filing a suit in the Court of Common Pleas for Chester County on November 13, 1996 for alleged violations of the First and Fourteenth Amendments under 42 U.S.C.A. S 1983 (West 1994), the Pennsylvania Constitution, and Pennsylvania's Sunshine Act.
Whiteland Woods does not base its claim on an alleged infringement of its fundamental rights under the First Amendment but instead on "what is arguably the most frightening and egregious abuse of governmental power which is the illegal deprivation of liberty by a municipal government through the raw use of its police force." Design of the intersection was complicated by several factors within the project limits including the Tributary to the Valley Creek, the proximity of a Township and County Park on the northeast and southeast corners of the intersection, historic structures on the northeast and northwest corners, and the presence of wetlands on the northeast corner.
West Whiteland Township officials requested that the trees remain undisturbed during construction.
Due to the efforts of West Whiteland Township, PennDOT, Toll Brothers, Allan Myers, Rotondo, and TPD, the intersection improvements were completed and the road was opened in time for the PA Route 100 lane closures.

West Whiteland Township has increased awareness of commercial recycling in the township by drafting an ordinance requiring businesses that serve food and beverages to recycle their glass and aluminum products.
West Whiteland’s recycling program is now a model for the countywide recycling effort targeting dining establishments.
Pennsylvania now is recycling more than 26 percent, or 2.5 million tons, of its municipal waste through curbside recycling programs supported by citizens, businesses, institutions, and state and local governments.
