An underlying principle in Code A, being the code of practise for the exercise by police officers of statutory powers of stop and search, is that every reasonable effort must be made to reduce to a minimum the embarrassment that a person being searched may experience.
Section 54 empowers the police to search a person who is in custody at a police station or is otherwise in police detention in order to ascertain whether he has anything which he can use for such purposes as interfering with evidence or assisting him to escape.

West Yorkshire Police v A (Employment Appeal Tribunal, Dec 1999)   (Site not responding. Last check: 2007-10-25)
It was at first thought to be resisted by the Police on the broad ground that whilst there had been discrimination against "A" on the grounds of her transsexuality, that discrimination was not unlawful but justified.
The Police's case, by the time it was heard at the substantive hearing, had become that "A", particularly in relation to searches of suspects, of accused persons and of prisoners, was not able to do the full range of the duties nowadays expected of a constable.
Further, we find that it would objectively be unreasonable to require the respondent [the Police] to employ the applicant as a police constable if in law and fact she could not carry out the full range of a police constable's duties.

On 9 March 1998 the Chief Constable of West Yorkshire rejected Ms A's application to become a constable in the West Yorkshire Police on the ground that, as a male-to-female transsexual, she could not perform the full searching duties required of a police constable.
But, again, the office of police constable does not require to be held by a man, as opposed to a woman, or by a woman, as opposed to a man, in order to preserve decency or privacy.
I conclude that being a man, as opposed to a woman, or vice versa, is not a genuine occupational qualification for the job of police officer in terms of section 7(2)(b) of the 1975 Act.
