While serving as attorney general of the state of Mississippi in the early 1980s, Bill Allain filed a suit asking the Mississippi Supreme Court to separate the functions of the executive and legislative branches of state government, especially in the budgetary process.
Attorney General Allain asserted that Mississippi’s 1890 Constitution required a separation of powers and that legislative officials could not serve in the executive branch.
Allain was born February 14, 1928, in Washington, Mississippi.

Allain was elected state attorney general in 1979 and earned a reputation as a consumer advocate, fighting utility rate increases and stopping the storage of nuclear waste in Mississippi.
The resulting decision, Allain vs. Alexander, is sometimes referred to as "Mississippi's Marbury vs. Madison," after the landmark decision of the United States Supreme Court which delineated the powers of the three branches of the federal government.
Allain ran for Governor in 1983 and during the campaign allegations arose that he engaged in improper acts with male transvestite prostitutes.
