XS4ALL (pronounced "access for all") is the second-oldest ISP in the Netherlands, after NLnet (But xs4all was the first company offering internet for individuals).
XS4ALL was established in Amsterdam in 1994 by Felipe Rodriquez, Rop Gonggrijp, Paul Jongsma and Cor Bosman.
XS4ALL insisted that the case to be settled by the courts, because it did not want to infringe on its customers' rights of free expression; however, the requests to follow traditional legal paths where ignored by the German ICTF.

XS4ALL Internet is refusing to comply with an instruction from the Dutch Ministry of Justice that it should tap the Internet traffic of one of its users as part of an investigation.
Nor will XS4ALL make any comment on the content of the study or the region in which this is occurring for it is not its intention that the investigation should founder.
XS4ALL has proposed in vain to the examining judge that the instruction be recast in terms which ensures the legal objections are catered for.

XS4ALL was summoned on Monday 8 April by lawyers of the Deutsche Bahn to remove the material.

XS4ALL starts case against NL government about costs wiretapping Internet provider XS4ALL today launched a court case against Dutch State, seeking compensation for the cost of making its network ready for wiretaps.
XS4ALL considers it unreasonable that these costs are not reimbursed, since these investments are made purely in the general interest of law enforcement and do not benefit the providers in any way.
XS4ALL is being forced to invest in wiretapping equipment while being obstructed in the development of new services that can make Internet communication more secure, such as VPN, VoIP and IPv6.

The decision to censor the xs4all webserver because of the radikal publication will probably cause and this censored magazine to become more popular on the Net.
XS4ALL has not yet received any official communication from the German justice department, nor from the Dutch justice department.

Neither the Dutch nor German authorities had ever ordered XS4ALL to remove the material, nor was publication of the articles prohibited in the Netherlands.
XS4ALL has long had a procedure in place to deal with complaints about allegedly illegal or libellous material, and subsequently requested Deutsche Bahn to substantiate how the material was a breach of Dutch law.
The railway company responded by initiating summary proceedings against XS4ALL in the Dutch courts, based on the EC "E-commerce" Directive of 8 June 2000.

XS4ALL have said that they have no legal obligation to deliver all mail that their customers are sent.
XS4ALL has always wanted to change that, has always opposed censorship and blocks of any kind (except self-imposed by users, instead of ISPs) and what this court ruling states is that because XS4ALL explicitly and implicitly imposes the conveyance obligation on themselves, it is as legal as if it were a forced obligation.
XS4ALL was formed in 1993 [xs4all.nl] by the infamous hackergroup Hacktic [hacktic.nl](RIP) and was the first dutch ISP to allow access to private persons.

The permission of seizure that scientology got against xs4all was issued on a false claim, relating to a remailer that had not been active on xs4all for more than 2 months.
This has led the church to ask the president of the district court of Amsterdam to grant permission for this seizure as a prelude to legal procedures concerning damages suffered by the church.
Since XS4ALL does not edit the homepages and has no mechanism of control over the contents we strongly feel that the users themselves are responsible for what they say on their homepage.

Without a single phonecall, fax, email or letter to Xs4all internet or the user that placed the Radikal pages on our website.
If there are pages that are not accepted by Germany, then Germany can always confront us, or the website owner, in a Dutch court of law.

Under Dutch law ISPs are entitled to claim for the administrative cost of each individual wiretap, but not for the cost of equipment which makes such snooping possible.
XS4ALL is claiming €500,000 - the amount it says it has spent since 2001 to ensure its network is accessible to police.
According to XS4all, providers in other European countries including Austria, Italy, Finland, France and the UK are already fully reimbursed for the expense of installing wiretaps.
