YellowTab will most likely neither confirm nor deny my comments here but there is a good reason for this.
If YellowTab didn't have code or were missing anything of significance they would by necessity have to switch to the OpenBeOS source base, in fact they would probably work on it themselves to speed it's development.
YellowTab also seem to be answering their critics, the so called "Linux-isation" comments seem to have been listened to and some things are being simplified, i.e.

YellowTAB's Zeta is the true inheritor of BeOS 5's fortune, as it is based directly on Dano/EXP's codeline (which was supposed to be BeOS 6 but was never finished as Be sold its IP to Palm).
YellowTAB should have concentrated on fixing this limitation of BeOS' Drive Setup instead of adding useless features like "Stings", application selection and "GCC version choice" that only bloat the installation and do not follow the paradigm that Be had and everyone loved: "keep it simple".
From startup on, the OS feels a lot like the legendary leaked version of Dano/EXP with most of the BeOS 5 apps able to work (about 8% of the BeBits' ~2900 BeOS apps won't run on Dano/Zeta because they are too old and the API has changed a bit).

yellowTab announced about a month ago that they would release the Pro version of their VideoEditor with ZETA Deluxe Edition, so this updated version for download includes all the filters, transitions and effects from the Pro version as well as many bug fixes.

Now, however, German startup YellowTAB has acquired licensing for the latest version of the BeOS code and is reworking it for a future release as the "Zeta" OS.
YellowTAB has a great advantage inheriting all this source code from Be, Inc. but also it has the inevitable curse that they will have to live in the shadow of the "legendary days" of R4.5 and R5.
What's clear is that YellowTAB is spending a lot of time adding new features when they arguably should be updating an OS that in need of better driver support for older hardware, plus nascent support for newer technologies.

yellowTAB, a small German development firm, claims the first official release version of the Zeta operating system is drawing close - possibly as early as May or June.

For some things I saw, heard and was told at YellowTab, I probably should have signed an NDA (non disclosure agreement).
True, the Zeta needs work, but since there is no final release out and it is being worked on more than I thought, this is a non issue.
I know YellowTab supports the community on several issues, so some things I have seen written against them are really unfair.

The BeOS community was rocked yesterday by the latest bombshell dropped in the escalating feud between The BeOS Journal (TBJ) and yellowTab Inc. In an article posted on beosjournal.org, a popular BeOS news site, Christ "Technix" Simmons revealed that Bernd Korz, CTO of yellowTab Inc., has an obese mother.
This revelation comes mere days after yellowTab issued a statement refuting TBJ's criticisms of their forthcoming Zeta operating system and suggesting that Technix's mother is sexually promiscuous.
Speculation is sure to run rampant as to how and if yellowTab will return fire, but a confidential source has told us to expect an announcement that Technix will not be invited to Bernd Korz's birthday party this year.

I’ve got to say the yellowTAB FAQ isn’t terribly well written at the moment, but I’m sure that will improve with time (it’s already improved a bit).
I base this on the fact that yellowTAB have negotiated access to source thru Palm, we know that BeBochs 2.0 runs on Zeta (it otherwise requires Dano) and yT’s site features screenshots that include Dockbert (or whatever that dock thing is called).
It’s also worth keeping in mind that yellowTAB has commercial investors, so you can be quite certain they wouldn’t do anything like using Dano components without licensing them.

The german company yellowTAB, GmBH continued to develop BeOS and renamed it Zeta (Zeta is the 6th letter in the greek alphabet, so it's BeOS 6).
Looncraz left the yellowtab team a few months ago to start off with his own free version of Beos 5.1 Dano called PhOS.
As far as I know is PhOS illegal! Only the yellowTAB GmBH is authorised to use the 5.1 source code and work on it.

After a couple of weeks of speculation, yellowTAB has just issued a statement declaring that they have filed for bankruptcy protection.
They give a short explanation of what this means to the company, and the next three months will be critical to the survival of the company, as an agent, assigned by the government, will audit their books and accompany them through this process, trying to find ways out of this situation.

I hate to be the bearer of bad news, especially when this seemed like a slam dunk, to me, but it is what it is. I had hoped to have the network stack and the USB stack as projects; that would have brought us much closer to release.
When I received the news that yellowTAB already had such a driver in development, I asked Bernd Korz, CEO of yellowTAB, if he could imagine to collaborate on this driver for the common benefit.
He liked the idea and since yellowTAB had not signed an NDA to make the driver, there was nothing in the way for making this happen.

A firm called Yellowtab will exhibit an updated version of code it licensed from BeOS and is set to show it at mammoth computer fair, CeBIT, which starts in Hannover Germany on the 12th of March.
