The State attempts to explain away the Conference Report's affirmation of Ray by asserting that "[t]he reference to Ray in the Conference Report confirms only that the broad language of § 1018 does not undo the careful holding in Ray that the field of tanker design and construction is preempted."  Unites States v. The Northern Trust Company, et al
The United States' investigation concentrated on the period from January 1992 through January 1994 and on the practices of The Northern Trust Company, which is the lead bank among the four defendants and has, during the past three years, taken over increased responsibility for mortgage loan processing for the three affiliates.
The United States maintains that, while not dispositive in themselves, the differential denial rates should have caused the defendant banks to examine their loan processing and underwriting in order to determine whether they were engaged in disparate treatment of loan applicants on a basis prohibited for the fair lending laws.
The United States reserves the right to review the circumstances surrounding the denials reviewed by the banks, and may identify any persons ho may be entitled to higher awards withing the agreed ranges.

Because the delegations from only two states were at first present, the members adjourned from day to day until a quorum of seven states was obtained on May 25.
Among the chief points at issue were how much power to allow the central government, how many representatives in Congress to allow each state, and how these representatives should be elected--directly by the people or by the state legislators.
